1 Validity
a) The conditions, as shown here during the time of purchase, govern all internet purchases at the Marmelot web shop.
b)These Conditions (including any variation or modification thereto) shall be governed by and construed in accordance with the laws of Belgium.
You irrevocably agree to submit to the exclusive jurisdiction of the courts of Belgium (RPR Trunhout) for settlement of any disputes or matters arising out of or concerning these Terms and Conditions, the Privacy Policy or their enforceability.
c) In case there are differences between these conditions in english and the conditions in dutch - also available from this page- the dutch text will take preference.
2 Prices, taxes and duties
a) The prices shown on our website are including all applicable EU taxes, unless indicated otherwise.
b) Companies registered within the European Union (except Belgium), supplying a valid VAT number during checkout, are entitled to order at a 0% intracommunautary vat rate.
If you select this option, prices will be adjusted during checkout. Final prices are shown on the order overview page before you confirm your order.
c) Customers with shipping addresses outside the European Union, may have to comply with additional local regulations and may have to pay duties. Duties, costum clearance fees or any
other costs apart from bare shipping costs are not included in the price and will have to be paid by the customer. Please contact your own tax office for more information.
Marmelot will never be held responsible for duties, taxes, product seizures or other government actions, nor will any resulting costs be covered, refunded or be a reason
for other claims.
3 Purchase agreement
The products on our webpage are intended to invite customers to place an order.
By placing an order the customer indicates his/her interest in our products. After ordering the customer will receive an order confirmation by email.
Apart from the case described below, a purchase agreement is assumed to exists either after payment has been received by Marmelot or after the goods are shipped or after Marmelot accepts an order by email.
Apart from custom made orders, the customer can cancel his order at any time before payment.
In case products are out of stock or there are mistakes on our webpage, Marmelot will contact the customer and if applicable make an alternative offer.
The customer can choose freely to accept or decline such an offer. In the latter case, it is assumed that no purchase agreement has existed at any time and any payment by the customer will be fully reimbursed.
4 Delivery, shipping costs and liability during transport
If there are any shipping costs to be paid by the customer, they will be clearly indicated during checkout. Marmelot is responsible for transport to the customer.
Transport damage or loss should be reported by the customer as soon as possible. After consulting with the customer, Marmelot can decide to resend or (partially) reimburse the
damaged goods. If applicable, the customer is expected to help support claims to the transport company.
Marmelot cannot be held responsible for damage beyond the (value of the) products itself, such as- but not limited to- damage resulting from not delivering goods, late deliveries or partial deliveries.
5 Return shipments
The law has limited the usual right to return ordered goods in case of foodstuffs. Apart from any remaining legal obligations, it is not possible to return ordered goods.
In case you are not satisfied with our products, please contact us and we will try to find a mutually acceptable solution.
6 Transfer of ownership
All goods remain property of Marmelot until the full purchase price has been paid.
7 Payments
Unless explicitly agreed upon, all orders will be shipped only after full payment has been received. The available payment methods are shown and can be selected during the checkout process.
8 Guarantee
a)
Marmelot guarantees that at the time of delivery the goods are similar to the goods described on the website concerning composition, weight and properties.
Small differences in packaging and labeling as compared to pictures shown on the website are possible and are no reason to terminate the purchase agreement.
b)
Any product deficiencies should be reported within 7 days after receiving the goods.
c)
In case of deficiencies of any kind, you are entitled to replacement or a (partial) reimbursement of the purchase sum.
Marmelot may refuse replacing goods in case they are out of stock or in case replacement is only possible at high additional costs. In this case deficient goods will be reimbursed.
9 Internet sales conditions
a) No additional conditions to those mentioned here are applicable.
b) Before the payment procedure is initiated, you will be shown a complete overview of your order including all ordered products, their price, shipping and paying conditions and your own data.
Any errors can be easily changed throughout the checkout process and in this final overview.
c) Product details are listed on the product pages. Additional information will be provided on request, if available.
d) If you are dissatisfied in any way or wish to use our guarantee, please contact us by email.
e) You can safe these conditions on your computer or make a printout. They will not be sent with your delivery.
f) Conditions regarding payment, delivery and specifics regarding your order will be shown in an overview before payment is initiated and will be send by email after your order confirmation.
10 Privacy statement
Marmelot respects your privacy. By ordering at Marmelot you need to supply certain personal data. We will only use these data to handle
your order and for our legally required administration. We may need to supply data to external partners like the payment provider and the transport company. The transferred data
will be kept to the minimum necessary to process your order. Apart from legal requirements and the exception mentioned before, we will never supply your data to a third party.
You will not be contacted with commercial offers, unless you explicitly agree. Statistical page visiting data are gathered anonymously and are used to improve your shopping experience.
11 Limit of liability
We perform careful content checks of our external links, however we cannot be held responsible for their content. The content of linked pages is the sole responsibility of their owner.
12 Final clause
If any part of these Terms and Conditions is found to be invalid, illegal or unenforceable in any respect, it will not affect the validity or enforceability of the remainder of the Terms and Conditions.
